Lessor, in their sole discretion, may terminate this Agreement if any or all of the following events occur: Failure by Lessee to pay the rental fee or any other charges due hereunder when the same is due; Lessee fails to keep the Premises in a safe and clean condition; Lessee uses and/or occupies the Premises in a manner that causes an interference or disturbance with the use and occupancy of the Premises by Lessor and/or other guests or; Lessee fails to perform any covenants or contractual obligations under this Agreement.
The Lessee hereby covenants and agrees to indemnify, defend and hold harmless the Lessor, Greg Mullins, Stacy Bredendieck, Rainbow Rentals of Macon County, LLC, Rainbow Springs Campground, LLC (d/b/a Winding Stair Farm), and any officer, employee, contractor, or agent thereof from any and all claims or liabilities which may arise from any cause whatsoever as a result of Lessee’s use and occupancy of the Premises, and further shall indemnify the Lessor for any losses which the Lessor may suffer in connection with the Lessee’s use and occupancy or care, custody and control of the Premises. The Lessee also hereby covenants and agrees to indemnify and hold harmless the Lessor from any and all claims or liabilities which may arise from any latent defects in the subject Premises that the Lessor is not aware of at the signing of the lease or at any time during the lease term.
Lessee agrees to irrevocably and unconditionally release Lessor, Greg Mullins, Stacy Bredendieck, Rainbow Rentals of Macon County, LLC, Rainbow Springs Campground, LLC (d/b/a Winding Stair Farm), and any officer, employee, contractor, or agent thereof from any and all liability, by way of subrogation or otherwise, for any loss, injury, or damage to equipment, property or person covered by any insurance policy held by Lessee.
Lessee agrees to assume liability for any and all damages caused to the Premises as a result of Lessee’s acts and/or failure to act, along with any expenses accrued due to the repair and/or replacement of any item or amenity of the Premises.
